alt textPivotal Law Group is very proud to announce a new member of our team, Ada K. Wong, as an associate attorney.  Ada is a California native who received her B.A. in Communication from UC Davis in 2008 and J.D. from UW School of Law in 2012.  Prior to joining the firm, Ada worked at a law firm in Bellevue where she devoted her entire practice to litigation.  She has a proven track record of being an effective and zealous advocate for her clients and we are very excited to have her join us at Pivotal.

Her practice now includes civil litigation, employment law, personal injury, civil rights, and business law.  She is licensed in California and Washington.  Some of her recent achievements include a six-figure settlement agreement with a Washington based company in an employment matter as well as finishing her first federal jury trial for a police misconduct case against the Seattle Police Department and its officers. 

Ada is fluent in Cantonese and basic Mandarin.  She is also actively involved in the community through several organizations, including the Vietnamese American Bar Association of Washington where she currently serves as the Co-President-Elect.

Ronald Bueing Testifies Before Senate Trade and Economic Development Committee

Pivotal Law Group’s Ronald Bueing testified before the Washington State Senate Trade & Economic Development Committee today on state B&O tax issues. Bueing spoke alongside Michelle DeLappe, chairperson of the Washington State Bar Association’s State and Local Tax Committee. Also testifying before the committee was Gerald Swanson, director at KOM Consulting and adjunct professor at the University of Washington School of Law.

Ron Bueing Speaks on Washington Excise Taxes

Consumer Alert: Mailings from Compliance Services, Corporate Records Service

The Washington Secretary of State has sent out a Consumer Alert regarding a notice mailed to businesses from “Compliance Services” or “Corporate Records Service.” The Washington Secretary of State’s website writes:

> “Please be aware that COMPLIANCE SERVICES or CORPORATE RECORDS SERVICE (not to be confused with the Washington corporation, Compliance Services, Inc.) is mailing notices to business entities requesting that ’Annual Minutes’ and a fee of $125.00 be sent to them for filing.> > These notices are NOT from the Washington Secretary of State, Corporations and Charities Division. ’Annual Minutes’ are NOT required to be filed with the Secretary of State. They are to be kept by the business entity itself. Do NOT confuse these notices with the annual report notices sent by the Washington Secretary of State, or the Business Licensing Services at Department of Revenue reminding each business to file its 2012 annual report.> > If you have questions about these notices please contact the Corporations and Charities Division at corps@sos.wa.gov or call 360-725-0377.”

Union Square to Host American Lung Association's 2012 Stair Climb

alt textLooking for a way to celebrate fall and support a great cause? Check out the American Lung Association’s “Fight for Air” Stair Climb, hosted by Union Square on Sunday, October 28th at 9:00 AM. Test your legs–and your lungs–by climbing 51 flights of stairs at Two Union Square!

Those interested in family-friendly activities are invited to participate in a shorter “Scare Climb,” where an adult and up to two kids can climb 8 stories of Halloween-themed flights in costume. In addition, Radio Disney will be on hand to provide entertainment and fun activities for the kids.

Proceeds from the event will support the American Lung Assocation’s efforts to fight for clean air policies at the local, state, and national levels. The ALA also helps keep kids from smoking and supports families who struggle with lung disease, such as asthma.

Pivotal attorney Ron Bueing has been selected to address the South Sound Chambers of Commerce Legislative Coalition’s Economic Development Summit on September 13, 2012 at Emerald Downs in Auburn, Washington. Update: Important Washington State Supreme Court Ruling

The Washington Supreme Court recently decided a case that may have a significant impact on nonjudicial foreclosures in Washington. The full opinion can be found here.

Lenders who work with MERS and conduct foreclosures in Washington should read this decision carefully; and borrowers who are facing foreclosure on loans “owned” by MERS should read this as well. It raises new complications and defenses for any foreclosure of a MERS loan.

2012 MXD Tennis Championships Raises +$37,000 for Diabetes Research

Pivotal Law Group was a proud sponsor of the 2012 MXD Tennis Championships, held July 27-29, at the Bellevue Club. The weekend included mixed doubles tournament play and a social event featuring refreshments, exhibition tennis, and a silent auction. This year’s tournament raised proceeds of over $37,000, which were donated to the Juvenile Diabetes Research Foundation. Pivotal Law Group is honored to help support a great cause!

Attorney Christopher Thayer Negotiates $90,000 Settlement

alt text Pivotal lawyer Chris Thayer was recently able to successfully negotiate a substantial settlement on behalf of an injured bicyclist against a large construction contractor in Seattle. The contractor had cut a trench adjacent to the sidewalk and failed to post proper safety warnings or protective barriers. Mr. Thayer’s client was thrown from his bicycle and seriously injured as a result of this unguarded trench. Mr. Thayer’s client required shoulder surgery and missed several months from work. The contractor fought the case hard and denied liability, claiming that it was Mr. Thayer’s client’s fault. However, when the contractor’s own safety expert acknowledged during his deposition that the contractor “could have done better”, the insurance company for the contractor ultimately agreed to settle for $90,000.

Attorney Michael Warren Captures Rare Shot of Northern Lights

Here’s what Mike had to say about it: <p>“On July 12 there was a solar flare on the sun. On July 14 the flare hit the earth, allowing the aurora borealis (Northern Lights) to be seen well south of the Arctic. I happened to be leading a Seattle Mountaineers climb of Little Tahoma on July 14. We arose to prepare for our summit climb at 2:00 AM, at the height of the show! To the naked eye, one could see only white lights, but the 30 second exposure of my camera captured the colors of the Northern Lights! After the show, we summited Little Tahoma (11,138’), the third highest peak in Washington, in a 17-hour push from basecamp and back. For the photograph, I used a Nikon D200, with a Nikon 18-200 lens at 18mm, f/3.5, 30” exposure, ISO 800 (I used rocks as a makeshift tripod). The only post processing done was sharpening and noise reduction in PS CS5”. </p>

Mark Shepherd Negotiates $4.0 Million Settlement from State DOC

Pivotal Law Group is pleased to announce that attorney Mark Shepherd has negotiated a major settlement on behalf of a 26-year-old man who suffers permanent brain damage and physical impairments from a severe beating at the Washington Corrections Center (Shelton).

alt text Ryan Alwine, 26, has received a $4.0 million settlement from the Washington State Department of Corrections (DOC) following a 2006 assault by cellmate Eddie Hopkins, an individual with a long history of mental illness, violence, and instability. Alwine sustained severe traumatic brain injury, multiple facial fractures, and multiple deep lacerations to his head and face as corrections officers looked on.

According to Shepherd, “When Hopkins was transferred to Shelton, DOC personnel either failed to obtain or ignored his history of mental illness and violence. They also did not act on an internal email distributed hours before the attack urging that Hopkins be evaluated as soon as possible to determine his mental status and fitness for housing in the general prison population.”

“DOC failed to adopt or follow even simple procedures to identify and isolate a demonstrably violent inmate. The Department put people at great risk. Ignoring their own directive resulted in this tragic assault on a vulnerable person like Ryan Alwine,” said Shepherd.

“This settlement gives Ryan some measure of hope, help, and a more promising future during his struggle to recover from a preventable tragedy.”

The settlement is thought to be one of the largest of its kind in state history.
