McKean practices in civil litigation, representing individuals and small businesses in lawsuits vindicating their legal rights. McKean has five years’ experience litigating complex cases regarding insurance, employee benefits and ERISA, and employment matters.

McKean joined Pivotal Law Group after relocating to Seattle with his fiancé, a native of the Pacific Northwest. McKean is enjoying exploring Seattle and the beautiful Washington wilderness, as well as putting his skills to work on behalf of Pivotal’s clients.

McKean Represents Policyholders Against Insurers That Wrongfully Deny Claims

Insurance policyholders reasonably expect that their insurance company will treat them fairly. Insurers violate the law when they put their own interests over those of their policyholders; for instance, by unreasonably refusing to pay benefits that are due under the policy.

Washington policyholders who are subject to unfair treatment by insurers have significant rights under Washington’s Insurance Fair Conduct Act (“IFCA”) and Consumer Protection Act (“CPA”). Policyholders whose insurers unreasonably deny claims or otherwise act unfairly or deceptively have the right to hold their insurer accountable in court, where IFCA and the CPA level the playing field by entitling successful policyholders to recover their court costs and attorney’s fees from the culpable insurer.

McKean Represents Employee Benefit Plan Participants in Disputes Under ERISA

Many people obtain health, life, disability or similar coverage through benefit plans sponsored by their or their family member’s employer. Employer-sponsored coverage is governed by the federal Employee Retirement Income Security Act (“ERISA”). ERISA gives benefit plan participants the right to challenge denials of benefits or payment, e.g., denials of prescription drug or health care treatment or denials of disability benefits. ERISA entitles plan participants who successfully challenge wrongful denials of benefits in court the right to recover their attorneys’ fees and court costs.

McKean represents ERISA participants and beneficiaries who have coverage unreasonably or wrongfully denied by the ERISA plan or insurance company. McKean has obtained favorable outcomes in ERISA disputes regarding disability, health, and life insurance benefits, against some of the country’s largest employers.

McKean Represents Employees in Employment Disputes

McKean represents employees in lawsuits enforcing their rights to be free from discrimination and be fairly paid by their employer. Federal and Washington law value diversity and forbid workplace discrimination, including underpayment, harassment, or retaliation for complaining about discrimination. The law also protects employees’ rights with respect to pay, prohibiting employers from unfairly withholding paychecks or underpaying their workers. Many individuals desire certainty regarding their families and business affairs as well as regarding their own health care in the event they are unable to make major decisions for themselves. McKean provides estate planning advice to business owners looking towards retirement, young families just starting out, and people in between.

McKean plays in active role in his legal community, including volunteering to serve on committees of the King County Bar Association association as well as with the Washington chapter of the American Civil Liberties Union (ACLU).

Outside of practicing law, McKean is an outdoor enthusiast. He spends free weekends backpacking and has enjoyed exploring the Cascades, Olympics and Puget Sound. He regularly commutes to work on his bicycle. An avid runner, he has completed several marathons and is always looking for a new challenge.


McKean earned his J.D. cum laude from the University of Pittsburgh School of Law. He earned his B.A. magna cum laude from the University of Maine, graduating in three years.


He received numerous law school awards, including the “Order of the Barristers,” awarded each year to ten graduating students for excellent oral and written advocacy; two CALI “Excellence in the Future” awards as the highest scoring student in Constitutional Law and in Freedom of Religion; and the Dean’s Scholarship for outstanding academic performance.


He served as a Research Editor on the University of Pittsburgh Law Review, where he published The Future of Conflicts Between Islamic and Western Financial Systems: Profit, Principle and Pragmatism.

Professional Affiliations

McKean is a member of the King County Bar Association, serving on KCBA’s CLE Committee and Young Lawyers Division Services Committee. McKean plans and speaks at KCBA Continuing Legal Education seminars.

McKean is an active member of the Washington Association for Justice, the oldest and largest civil justice advocacy organization in the Pacific Northwest which works to protect the legal rights of wronged consumers, injured citizens, patients and workers. McKean is also a member of the American Association for Justice, United Policyholders, and Public Justice.

McKean is admitted to practice law in Washington as well as before the United States District Courts for the Western District of Washington, the Western and Eastern Districts of Pennsylvania, and the United States Courts of Appeals for the Third and Fourth Circuits.

Prior Legal Experience

Before joining Pivotal Law Group, McKean practiced in a Pittsburgh, PA law firm litigating complex lawsuits on behalf of insurance policyholders and employees.

Prior to entering private practice, McKean served as a law clerk to the Honorable Robert L. Boyer, Common Pleas Judge of the 28th Judicial District of Pennsylvania, assisting the judge in researching the law and issuing rulings in a variety of cases.

During law school, McKean practiced as a certified legal intern in the University of Pittsburgh School of Law Civil Practice Clinic, providing pro bono representation to indigent members of the local community.
